APA – Greetings fellow land use gurus! I’ll be seeing many of you in Vernal, but in the meantime I’m in need of some assistance. Brigham City will be updating its general plan with a comprehensive overhaul that will include the housing and water conservation elements as mandated by state code, along with a downtown revitalization element and attendant deliverables, as well as the other elements traditionally included in a general plan (land use, transportation, parks and open space, etc.). Thank you Paul for your passion! I think that the town will lose also, but let me be a little more circumspect. If this had been a freestanding sign, or an artificial extension of the building constructed simply for the purpose of more signage, I think the town wins. But because this is a mural on the front wall of the structure, I think the town loses. If I was a betting man (I’m not), my bet would be that the City will lose. I think that there are a number of cases that get close to making this a slam dunk for the pastry shop owner. Reed v Town of Gilbert almost got there. Masterpiece Cake Shop probably has something to say about it as well. There are a bunch of other cases relating to murals and art as free speech that will come into play. I am reaching out about HB406. Spanish Fork has operated with the practice of requiring developers to provide a cash deposit when they want a certificate of occupancy before landscaping or other improvements are finished. The deposit is released once the required improvements are finished. HB406 seems to erode our ability to require such a deposit for private landscaping.
