Street Sign Standards

<div style='font-family: Arial; font-size: 12pt; color: #000000'>This is not strictly speaking a planning question, but has anyone recently reviewed the MUTCD street sign standards and specified the spec that addresses street signs adjacent to highways?  Do they have to be green as opposed to black and white, (or any other color choice) just to meet the electro-reflectivity requirements?  I'd love to discuss creative solutions with you.  We'd like to keep our historic black and white motif if possible. <DIV>Jay Aguilar Willard City Planning 435-734-9881 No trees were killed in the sending of this message. Landscaping requirements - help request

Last Friday, the Utah Supreme Court issued its third decision in /B.A.M. v. Salt Lake County/.The Court ruled against B.A.M., affirming the trial court in all respects. In 1997 Salt Lake County required B.A.M. to dedicate a 40 foot right of way based on the County's road width standards, which were based on recommendations from UDOT and the Wasatch Front Regional Council (WRFC).After UDOT and WFRC informed the County that the standard had been increased to 53 feet, the County advised B.A.M. it would need to dedicate an additional 13 feet of right of way. B.A.M. appealed, arguing the additional 13 feet was an unconstitutional exaction.When the district court ruled in favor of the County, B.A.M. appealed again.The Court of Appeals affirmed, but the Supreme Court reversed and remanded for a new trial because the trial court should have applied the rough proportionality test adopted in /Dolan v. Tigard/.B.A.M. lost the second trial and again appealed to the Supreme Court, which again reversed the trial court, holding that the /Dolan /rough proportionality test was misapplied.The correct test is to compare the cost of the exaction against the government's cost of ameliorating the impact of a development.B.A.M. lost a third trial, which found the County's exaction was constitutional because B.A.M.'s cost ($83,997) was significantly less than the County's ($337,500).In calculating its costs, the County included not only its own costs, but also costs attributable to B.A.M.'s development which were borne by other government entities. B.A.M. challenged the County's cost calculation method, arguing it should include only the County's own costs.The Court rejected B.A.M.'s argument, saying it was a selective reading of /B.A.M. II/ and a narrow view of the rough proportionality standard.The Court reiterated its holding in /B.A.M. II,/ which requires consideration of costs to "the community."A proper rough proportionality analysis must consider an exaction's purpose in order to define scope of relevant governmental costs.If that purpose includes a development's impact on other government entities, their costs may also be included in the rough proportionality calculation.Here, the County was acting as an intermediary between the developer and other government entities that bear costs caused by B.A.M.'s development.Inclusion of all these costs in the County's calculation was thus proper. B.A.M. also complained that the trial court focused only the additional 13 foot exaction rather than the full 53 feet.However, the Court affirmed the trial court's conclusion that B.A.M. never objected to the initial 40 foot exaction.Thus, that issue was not before the Court. B.A.M. also contended the County's exaction was unreasonable under the multi-factor test set forth in/Banberry Development v. South Jordan City/.The Court rejected this argument as "flatly wrong" because the /Banberry/ test applies to the reasonableness of subdivision charges and not dedication exactions. The Court also rejected an equal protection claim and a complaint that the trial court refused to hear testimony from an expert witness because the claims were inadequately briefed.
